Model Policy on Data Privacy, CHLP (2024)

CHLP authored this model policy to provide examples of language that health departments and healthcare facilities can adopt to promote public health through the protection of private health information. The policy addresses concerns raised by the use of Molecular HIV Surveillance (MHS) which collects and analyzes patient HIV data without their notice or consent. This practice raises significant data privacy issues and opens people living with HIV up to criminalization and other negative collateral consequences. This adaptable policy is intended to promote data privacy and protect health data in health departments and healthcare facilities while increasing trust in the medical community and promoting the accessibility of health services, which is key to ending the HIV epidemic.
