Briefing Note: Criminalizing non-disclosure of HIV status, Ontario Working Group on Criminal Law and HIV Exposure (2012)
This briefing note provides an overview of HIV non-disclosure laws in Canada and recommendations for a different approach to the issue of HIV non-disclosure. It provides a brief history of HIV criminalization in Canada as well as a short overview of recent medical advancements in HIV treatment. In the note, the Ontario Working Group on Criminal Law and HIV Exposure encourages the adoption of prosecutorial guidelines that rely on scientific evidence and reflect the objectives of HIV prevention, treatment and care. The note also provides additional resources on criminal law and non-disclosure of HIV status in Canada.
