Guidance for a Legal Advocate Representing an HIV-Positive Client in a Criminal Exposure Case, The Center for HIV Law and Policy (2012)
A basic checklist to guide legal advocates representing an HIV-positive client in a criminal HIV exposure case. Although the elements of criminal HIV exposure statutes vary by jurisdiction, this checklist helps legal advocates identify the elements of the offense with which their client is charged. Additional information helpful in preparing for a criminal exposure case is included, such as the relative HIV transmission risks of various conduct and medical expert testimony or affidavits.
We encourage legal advocates to consult our companion resource for clients as well: Guidance for People Living with HIV Who Are At Risk of, or Are Facing, Criminal Prosecution for HIV Nondisclosure or Exposure.
