New York Prenatal Care Assistance Program (PCAP) Regulations, May 31, 2000
These are the implementing regulations that followed NY's passage, in 1997, of universal, mandatory testing of newborns. The regulations require that hospitals and diagnostic and treatment centers offering prenatal obstetric, maternity and/or newborn services, in order to qualify for PCAP Medicaid reimbursement rates or fees, must provide a comprehensive array of diagnostic, treatment, case managment and related services to pregnant women, including the routine offer of HIV counseling and testing. The mandated offer of HIV testing to pregnant women -- accompanied by counseling allowing for informed, written consent -- is widely believed to be responsible for the near-elimination of perinatal HIV transmission.
