The Supreme Court Case That Could Change Health Care Coverage for Millions of Americans, Equality Federation and CHLP (2025)

This explainer summarizes the main issues in the Supreme Court case Kennedy v. Braidwood and was produced by the Equality Federation Institute and CHLP. Kennedy v. Braidwood challenges the Affordable Care Act’s requirement that private insurers cover preventative health care services, including cancer screenings, contraception, and HIV prevention medication (PrEP), at no cost to patients. The plaintiffs argue that this mandate violates their religious freedoms, particularly objecting to PrEP coverage. If the Court rules in their favor, millions could lose access to free preventative care, especially in states without their own protections. This could worsen health disparities, particularly for Black and Latine communities. While coverage remains intact for now, advocacy and state-level action are crucial to maintaining access and public awareness.
